Heat celebrate in the streets of Miami

(AP) ? The NBA championship trophy was center stage, bathed in white light and sitting on a pedestal. And each Miami Heat player offered it a different greeting.

Mike Miller bowed. Udonis Haslem kissed it three times. Chris Bosh hugged it, and LeBron James strolled past before waving at the crowd.

Dwyane Wade did something different. In a nod to his preferred postgame fashion style throughout the playoffs, he emerged with a pair of faux eyeglasses and slipped the frames onto the neck of the trophy. Heat president Pat Riley, coach Erik Spoelstra and team managing general partner Micky Arison all donned similar pairs of the black spectacles as well for the party.

The glasses were fake. The sentiments were all real.

And with that, two years after Wade, James and Bosh opened their time together with a celebration, they got the party they really wanted on Monday. Hundreds of thousands of people filled the streets of Miami for the Heat championship parade, and then 15,000 more got into the arena afterward for a long, loud reception for the NBA's new kings.

"It's the best feeling I've ever had. ... This was my dream, right here, to be able to hoist that Larry O'Brien Trophy up, hug it, grab it, never want to let it go," James said.

During the parade, players and coaches were on double-decker buses with friends and family, most of them taking photos and video of the crowd. Other Heat staff were on flatbed trucks, as confetti fell and horns blared every step of the way. Wade cradled the championship trophy in his arms for much of the ride.

"I appreciate all our fans for sticking with us," said the now two-time NBA champion Wade, adding, "Best fans in the world."

And then the party moved inside, with a similar setup to the event that welcomed James and Bosh to Miami to play alongside Wade in July 2010. Music blared for nearly an hour as fans danced for joy, before the arena went dark briefly ? and someone sneaked the trophy onto the stage.

For nearly 90 minutes afterward, the Heat relived so many aspects of the season, from Haslem's flagrant foul against Indiana's Tyler Hansbrough in the Eastern Conference finals ("the greatest flagrant foul in team history," Heat broadcaster Eric Reid told the crowd) to countless highlights from the NBA Finals against Oklahoma City, the Heat left few stones unturned.

Juwan Howard ? the first member of Michigan's Fab Five to win an NBA title ? did the Cabbage Patch dance, as teammates broke into absolute hysterics, waving their arms in time with him. Mario Chalmers was asked about why Wade and James yell at him so much on the court, as a montage of some of their more fiery moments played on the giant video screens. And the Miami natives, Haslem and James Jones, got perhaps the loudest ovations of anyone outside of the finals MVP.

"Feels great, man," said Haslem, who along with Wade is the lone holdover from Miami's 2006 championship club. "Changing my name from Mr. Miami to Mr. Two-Time. I ain't Mr. Miami no more. I'm Mr. Two-Time. ... It never gets old. But this one is more gratifying because of the way last season ended."

Spoelstra had a similar sentiment, talking to the crowd about the team's commitment, especially after Miami lost last season's finals to Dallas.

"People from the outside, they criticized this group, this team," Spoelstra said. "They counted this team out. But they never estimated how close this group was as a family. Every single one of these players had to sacrifice something, either money, opportunity, minutes to be a part of this team. And it was all for a moment like this."

Miami won the title by defeating Oklahoma City in five games in the NBA Finals. It was the second title for the Heat and the first for James, who nodded and pointed to fans for much of the parade. James came to Miami after seven years in Cleveland, and after he and the Heat fell in the finals a year ago, he's finally a champion.

"It's good being around other people who support LeBron," said Doug Mead of Toledo, Ohio, who came to the parade with his family. "They really don't like him in Ohio. They celebrate when he loses."

Everyone was celebrating in Miami on Monday. Arison snapped and tweeted several photos during the parade. Riley shouted "Thank you" to fans over and over, as his wife, Chris, stood to his left and led "Let's go Heat" chants.

Some fans began lining up for spots along the parade route Sunday night.

"I've been a fan since '89. For me personally I feel like I'm part of the Heat family," said Dexter Pace of West Palm Beach, Fla. "I've been through the goods, the bads, the losses, the trades, and now it's like someone in my family has accomplished something. .... It's going to mean a lot for the city of Miami, winning the championship."

As the event ended, Bosh thanked both the fans inside the arena and those outside, saying that without them, nothing would be possible for the Heat.

"It feels right," Bosh said. "This is how it's supposed to be ... and I would like to do it all the time."

Wells is a cathedral city and civil parish in the Mendip district of Somerset, England, on the southern edge of the Mendip Hills. Although the population recorded in the 2001 census is 10,406, it has had city status since 1205. It is the second smallest English city in terms of area and population after the City of London although, unlike the latter, Wells is not part of a larger metropolitan conurbation, and is consequently described in some sources as being England's smallest city.

The name Wells derives from the three wells dedicated to Saint Andrew, one in the market place and two within the grounds of the Bishop's Palace and cathedral. There was a small Roman settlement around the wells, but its importance grew under the Saxons when King Ine of Wessex founded a minster church in 704, around which the settlement grew. Wells became a trading centre and involved in cloth making before its involvement in both the English Civil War and the Monmouth Rebellion during the 17th century. In the 19th century, transport infrastructure improved with stations on three different railway lines.

The cathedral and the associated religious and architectural history have made Wells a tourist destination, which provides much of the employment. The city has a variety of sporting and cultural activities and houses several schools including The Blue School, a state coeducational comprehensive school originally founded in 1654 and the independent Wells Cathedral School, which was founded in 909 and is one of the five established musical schools for school-age children in Britain. The historic architecture of the city has also been used as a location for several films and television programmes.

History

The city was a Roman settlement but only became an important centre under the Saxons when King Ine of Wessex founded a minster church in 704. Two hundred years later, this became the seat of the local bishop; but in 1088, this had been removed to Bath. This caused severe arguments between the canons of Wells and the monks of Bath until the bishopric was renamed as the Diocese of Bath and Wells, to be elected by both religious houses. Wells became a borough some time before 1160 when Bishop Robert granted its first charter. Fairs were granted to the City before 1160.

Wells was listed in the Domesday Book of 1086 as Welle, from the Old English wiells, which was not listed as a town, but included four manors with a population of 132, which implies a population of 500?600. Earlier names for the settlement have been identified which include Fontanetum, in a charter of 725 granted by King Ina to Glastonbury and Fontanensis Ecclesia. Tidesput or Tithesput furlang relates to the area east of the bishops garden in 1245. An established market had been created in Wells by 1136, and it remained under episcopal control until its city charter from Elizabeth I in 1589.

During the English Civil War, Parliamentarian troops used the cathedral to stable their horses and damaged much of the ornate sculpture by using it for firing practice. William Penn stayed in Wells shortly before leaving for America, spending a night at The Crown Inn. Here he was briefly arrested for addressing a large crowd in the market place, but released on the intervention of the Bishop of Bath and Wells.

During the Monmouth Rebellion the rebel army attacked the cathedral in an outburst against the established church and damaged the west front. Lead from the roof was used to make bullets, windows were broken, the organ smashed and horses stabled in the nave. Wells was the final location of the Bloody Assizes on 23 September 1685. In a makeshift court lasting only one day, over 500 men were tried and the majority sentenced to death.

There was a port at Bleadney on the River Axe in the 8th century that enabled goods to be brought to within of Wells. In the Middle Ages overseas trade was carried out from the port of Rackley. In the 14th century a French ship sailed up the river and by 1388 Thomas Tanner from Wells used Rackley to export cloth and corn to Portugal, and received iron and salt in exchange. Wells had been a centre for cloth making, however in the 16th and 17th centuries this diminished, but the town retained its important market focus.

Wells has had three railway stations. The first station, Priory Road, opened in 1859 and was on the Somerset Central Railway (later the Somerset and Dorset Joint Railway) as the terminus of a short branch from Glastonbury. A second railway, the East Somerset, opened a branch line from Witham in 1862 and built a station to the east of Priory Road. In 1870, a third railway, the Cheddar Valley line branch of the Bristol and Exeter Railway from Yatton, reached Wells and built yet another station, later called Tucker Street. Matters were somewhat simplified when the Great Western Railway acquired both the Cheddar Valley and the East Somerset lines and built a link between the two that ran through the S&DJR's Priory Road station. In 1878, when through trains began running between Yatton and Witham, the East Somerset station closed, but through trains did not stop at Priory Road until 1934. Priory Road closed to passenger traffic in 1951 when the S&DJR branch line from Glastonbury was shut, though it remained the city's main goods depot. Tucker Street closed in 1963 under the Beeching Axe, which closed the Yatton to Witham line to passengers. Goods traffic to Wells ceased in 1964. A Pacific SR West Country, West Country Class steam locomotive no 34092 built by the British Railways Board was named City of Wells following a ceremony in the city's Priory Road station in 1949. It was used to draw the Golden Arrow service between London and the Continent. It was withdrawn from service in 1964, and rescued from a scrapyard in 1971. It is now undergoing a complete restoration on the Keighley and Worth Valley Railway in Yorkshire.

During World War II, Stoberry Park in Wells was the location of a Prisoner of War camp, housing Italian prisoners from the Western Desert Campaign, and later German prisoners after the Battle of Normandy. Penleigh Camp on the Wookey Hole Road was a German working camp.

City status was confirmed and formalised by Queen Elizabeth II by letters patent issued under the Great Seal dated 1 April 1974.

Governance

Wells City Council has sixteen councillors, elected from three wards: Central, St.Thomas and St.Cuthbert. It was previously known as Wells Municipal Borough. The City Council has responsibility for local issues, including setting an annual precept (local rate) to cover the council's operating costs and producing annual accounts for public scrutiny. They also evaluate local planning applications and work with the local police, district council officers, and neighbourhood watch groups on matters of crime, security, and traffic. This includes City Centre management including CCTV, an alcohol ban and regulating street trading permissions including the two funfairs held in the Market Place in May and November each year and the Wells In Bloom competition.

The city council's role also includes initiating projects for the maintenance and repair of city facilities, as well as consulting with the district council on the maintenance, repair, and improvement of highways, drainage, footpaths, public transport, and street cleaning. They are involved in the management of the Community Sports Development Centre at the Blue School, the skateboard park and allotments in the grounds of the Bishop's Palace, Burcott Road and Barnes Close. Conservation matters (including trees and listed buildings) and environmental issues are also the responsibility of the council. The Wells city arms show an ash tree surrounded by three wells, with the Latin motto Hoc fonte derivata copia (the fullness that springs from this well).

The Town Hall was built in 1778, with the porch and arcade being added in 1861 and the balcony and round windows in 1932. It is a Grade II listed building. It replaced the former on the site of the Market and Assize Hall in the Market Place, and a Canonical House also known as 'The Exchequer', on the authority of an Act of Parliament dated 1779. The building also houses the magistrates courts and other offices. The Assize court last sat here in October 1970.

Wells elects five councillors to Mendip District Council from the same three wards as are used for the City Council. The Mendip District was formed on 1 April 1974 under the Local Government Act 1972. The district council is responsible for local planning and building control, local roads, council housing, environmental health, markets and fairs, refuse collection and recycling, cemeteries and crematoria, leisure services, parks, and tourism.

Wells has one councillor on the Somerset County Council, which is responsible for running the largest and most expensive local services such as education, social services, libraries, main roads, public transport, policing and fire services, trading standards, waste disposal and strategic planning. Wells is part of the UK Parliament constituency of Wells. The current Member of Parliament is Tessa Munt of the Liberal Democrats. Wells is within the South West England constituency of the European Parliament which elects six Members of the European Parliament using the d'Hondt method of party-list proportional representation.

Wells is twinned with Bad D?rkheim in Germany and Paray-le-Monial in the Burgundy region of France. , Mary Bignal-Rand, The Rifles and Harry Patch have the Freedom of the City.

Geography

Wells lies at the foot of the southern escarpment of the Mendip Hills where they meet the Somerset Levels. The hills are largely made of carboniferous limestone, which is quarried at several nearby sites. In the 1960s, the tallest mast in the region, the Mendip UHF television transmitter, was installed on Pen Hill above Wells.

The water from the springs fills the moat around the Bishops Place and then flows into Keward Brook, which carries it for approximately a mile west to the point where the brook joins the River Sheppey in the village of Coxley.

Along with the rest of South West England, the Mendip Hills have a temperate climate which is generally wetter and milder than the rest of England. The annual mean temperature is about 10??C (50??F) with seasonal and diurnal variations, but due to the modifying effect of the sea, the range is less than in most other parts of the United Kingdom. January is the coldest month with mean minimum temperatures between 1??C (34??F) and 2??C (36??F). July and August are the warmest months in the region with mean daily maxima around 21??C (70??F). In general, December is the dullest month and June the sunniest. The south west of England enjoys a favoured location, particularly in summer, when the Azores High extends its influence north-eastwards towards the UK.

Cloud often forms inland, especially near hills, and reduces exposure to sunshine. The average annual sunshine totals around 1600 hours. Rainfall tends to be associated with Atlantic depressions or with convection. In summer, convection caused by solar surface heating sometimes forms shower clouds and a large proportion of the annual precipitation falls from showers and thunderstorms at this time of year. Average rainfall is around 800?900?mm (31?35?in). About 8?15 days of snowfall is typical. November to March have the highest mean wind speeds, with June to August having the lightest. The predominant wind direction is from the south west.

Demography

The population of the civil parish, recorded in the 2001 census, is 10,406. Their average age is 44 years with 2,602 of the people being over the age of 65 years. 4,208 of the population are considered to be economically active. Within the 1,702 people living in the central ward 1,690 are white, and the predominant religion is Christian. Similar profiles are seen amongst the 4,577 people living in St Cuthberts Ward, and the 4,126 living in St Thomas's ward.

Economy

Following construction of the A39/A371 bypass, the centre of town has returned to being a quiet market city. It has all the modern conveniences plus shops, hotels and restaurants. Wells is a popular tourist destination, due to its historical sites, its proximity to Bath, Stonehenge and Glastonbury and its closeness to the Somerset coast. Also nearby are Wookey Hole Caves, the Mendip Hills and the Somerset Levels. Somerset cheese, including Cheddar, is made locally. Wells is part of the Wells & Shepton Mallet Travel to Work Area which also includes Glastonbury, Cheddar and surrounding areas.

Transport

Wells is situated at the junction of three numbered routes. The A39 goes north-east to Bath and south-west to Glastonbury and Bridgwater. The A371 goes north-west to Cheddar and east to Shepton Mallet. The B3139 goes west to Highbridge and north-east to Radstock. Wells is served by FirstGroup bus services to Bristol, Bath, Frome, Shepton Mallet, Yeovil, Street, Bridgwater, Taunton, Burnham on Sea and Weston-super-Mare, as well as providing some local service. Some National Express coach services call at Wells. The bus station is in Princes Road. The Mendip Way and Monarch's Way long-distance footpaths pass through the city, as does National Cycle Route 3.

Education

The Blue School, founded in 1654, is a state coeducational comprehensive school and has been awarded Specialist science college status. It has 1,453 students aged 11?18 of both sexes and all ability levels.

Wells Cathedral School, founded in 909, is an independent school that has a Christian emphasis and is one of the five established musical schools for school-age children in Britain. The school teaches over 700 pupils between the ages of 3 and 18. The school's boarding houses line the northern parts of the city and the music school retains close links with Wells Cathedral. The primary schools in Wells are Stoberry Park School, St Cuthbert's Church of England Infants School, St Joseph and St Teresa Catholic Primary School, and Wells Central CofE Junior School.

Culture

Wells and Mendip Museum includes many historical artefacts from the city and surrounding Mendip Hills. Wells is part of the West Country Carnival circuit.

The Wells Film centre shows current releases and, in conjunction with the Wells Film Society shows less well known and historical films. The previous cinema, The Regal in Priory Road, closed in 1993 and is now Kudos Nightclub. It was built in 1935 by ES Roberts from Flemish bond brickwork with Art Deco features. It is a Grade II listed building, and was on the Buildings at Risk Register until its restoration which included the restoration and repair of the stained glass fa?ade. Wells Little Theatre is operated by a voluntary society which started in 1902. In 1989 they took over the old boy's building of Wells Blue School, where they put on a variety of operatic and other productions.

Religious sites

A walled precinct, the Liberty of St Andrew, encloses the twelfth century Cathedral, the Bishop's Palace, Vicar's Close and the residences of the clergy who serve the cathedral. Entrances include the Penniless Porch The Bishop's Eye and Brown's Gatehouse which were all built around 1450.

The cathedral is of the Church of England Diocese of Bath and Wells. Wells has been an ecclesiastical city of importance for hundreds of years. Parts of the building date back to the tenth century, and it is a grade I listed building. It is known for its fine fan vaulted ceilings, Lady Chapel and windows, and the scissor arches which support the central tower. The west front is said to be the finest collection of statuary in Europe, retaining almost 300 of its original medieval statues, carved from the cathedral's warm, yellow Doulting stone. The Chapter House, at the top of a flight of stone stairs, leading out from the north transept is an octagonal building with a fan-vaulted ceiling. It is here that the business of running the cathedral is still conducted by the members of the Chapter, the cathedral's ruling body. Wells Cathedral clock is famous for its 24-hour astronomical dial and set of jousting knights that perform every quarter hour. The cathedral has the heaviest ring of ten bells in the world. The tenor bell weighs just over 56?CWT (6,272?lb, 2,844?kg).

The Bishop's Palace has been the home of the bishops of the Diocese of Bath and Wells for 800 years. The hall and chapel date from the 14th century. There are of gardens including the springs from which the city takes its name. Visitors can also see the Bishop's private chapel, ruined great hall and the gatehouse with portcullis and drawbridge beside which mute swans ring a bell for food. The Bishop's Barn was built in the 15th century.

The Vicars' Close is the oldest residential street in Europe. The Close is tapered by to make it look longer when viewed from the bottom. When viewed from the top, however, it looks shorter. The Old Deanery dates from the 12th century, and St John's Priory from the 14th.

The Church of St Cuthbert (which tourists often mistake for the cathedral) has a fine Somerset stone tower and a superb carved roof. Originally an Early English building (13th century), it was much altered in the Perpendicular period (15th century). The nave's coloured ceiling was repainted in 1963 at the instigation of the then Vicar's wife, Mrs Barnett. Until 1561 the church had a central tower which either collapsed or was removed, and has been replaced with the current tower over the west door. Bells were cast for the tower by Roger Purdy.

Sport

The city has two football clubs, one being Wells City F.C., past winners of the Western League. The oldest football club in Wells though is Belrose FC who play their football in the Mid-Somerset Football League at Haybridge Park. Wells Cricket Club runs eight sides across senior, junior and ladies cricket. Wells Wanderers Cricket Club are based in Meare.

Mid Somerset Hockey Club and Wells City Acorns Hockey Club both play on the Astroturf pitches at the Blue School, where several other sports clubs are based. Wells Leisure Centre has a swimming pool, gymnasium, sports hall, sauna, steam room, relaxation area and solarium. The 18 hole Wells Golf Club is on the outskirts of the city and also has a driving range.

In popular culture

Elizabeth Goudge used Wells as a basis for the fictional cathedral city of Torminster, in her book City of Bells.

Wells has been used as the setting for several films including: The Canterbury Tales (1973), A Fistful of Fingers (1994), The Gathering (2002), The Libertine (2005), The Golden Age (2007), and Hot Fuzz (2007) The cathedral interior stood in for Southwark Cathedral during filming for the Doctor Who episode The Lazarus Experiment.

Harry Patch ? last trench veteran of World War I, and at 111, briefly the oldest man in Europe and 3rd oldest man in the world. He was born in the nearby village of Combe Down and at the time of his death in July 2009 he was living in local care home Fletcher House. Hugh of Wells ? native of Wells, Bishop, elder brother of Jocelin of Wells. Jocelin of Wells ? native of Wells, Bishop, aided in creation of Magna Carta and largely responsible for the construction of the cathedral. Edgar Wright ? film and television director. Directed Hot Fuzz, which was filmed in the city.

    The series resumed eight years later, when the Chicago Cardinals clobbered the Argonauts, 55-26, in Toronto.? In 1960, the Steelers slammed the Argonauts in Toronto, 43-16.

    The exercise ended the following year, with a pair of contests played three days apart.? On August 2 in Toronto, the Cardinals (which had since moved to St. Louis) cold-cocked the Argonauts, 36-7.? On August 5, the Bears bested the Alouettes in Montreal, 34-16.

    But the Canadians saved a little face three days after that.? In the one and only AFL-CFL game, the Tiger-Cats took apart the Buffalo Bills in Hamilton, 38-21.

    In the past 51 years, no NFL team (or AFL, during the league?s remaining years of existence) has ever again played a CFL team, in Canada or elsewhere.?     The channel said Friday it has ordered 13 episodes of "Devious Maids" from producer Marc Cherry. The series is about maids working for the rich and famous in Beverly Hills and counts "Desperate Housewives" star Eva Longoria as an executive producer.

    "Desperate Housewives" ended its run on ABC this season. The network had been weighing "Devious Maids" for its 2012-2013 schedule but passed.

    The "Devious Maids" cast includes Ana Ortiz, Judy Reyes, Grant Show and Susan Lucci. Lifetime is aiming for a 2013 debut for the series, which is based on a Mexican telenovela and produced by ABC Studios.

    (AP) ? Mitt Romney pledged Thursday to address illegal immigration "in a civil but resolute manner" and said he will overhaul the green card system for immigrants with families and end immigration caps for their spouses and minor children.

    Romney also told a Hispanic audience that his administration would complete a 2,000-mile border fence to help stem illegal immigration. He faulted President Barack Obama's recent plan to ease deportation rules for some children of illegal immigrants as little more than a "stop-gap measure."

    "As President, I won't settle for a stop-gap measure. I will work with Republicans and Democrats to find a long-term solution," Romney told the National Association of Latino Elected and Appointed Officials. "I will prioritize measures that strengthen legal immigration and make it easier. And I will address the problem of illegal immigration in a civil but resolute manner. We may not always agree, but when I make a promise to you, I will keep it."

    Obama will speak to the same group Friday.

    Romney has struggled in recent days to clarify his immigration policy as he pivots from the harsh rhetoric that defined the month-long GOP primary to a general election audience in which Latinos will play a critical role. The stakes are high not only for states with larger Hispanic populations such as Florida, Nevada and Colorado, but for a growing number of other battlegrounds ? Ohio, North Carolina and Virginia, among them ? where even a modest shift among Latino voters could be significant.

    At least 1 in 6 Americans is of Hispanic descent, according to the Census Bureau.

    "We're talking about a significant share of the American electorate that could well decide this election," said Arturo Vargas, executive director of the Latino association. "It's only now that both candidates are turning their attention to the Latino vote."

    Romney's speech comes as the Supreme Court prepares to render judgment on a get-tough Arizona law and after Obama announced plans to ease deportation rules for some children of illegal immigrants.

    "Some people have asked if I will let stand the president's executive action," Romney said in his prepared remarks. "The answer is that I will put in place my own long-term solution that will replace and supersede the president's temporary measure."

    Obama is riding a wave of Latino enthusiasm over his decision to allow hundreds of thousands of illegal immigrants to stay in the country and work. Under the administration plan, illegal immigrants can avoid deportation if they can prove they were brought to the United States before they turned 16 and are younger than 30, have been in the country for at least five continuous years, have no criminal history, and graduated from a U.S. high school or earned a GED or served in the military.

    The new policy could help anywhere from 800,000 young immigrants, the administration's estimate, to 1.4 million, the Pew Hispanic Center's estimate.

    Romney had previously refused to say whether he would reverse the policy if elected, but he has seized on the temporary status of Obama's plan as his prime criticism. The Republican has also highlighted what he calls the president's "broken promises" to deliver comprehensive immigration reform during his first term.

    "Unfortunately, despite his promises, President Obama has failed to address immigration reform," Romney said. "For two years, this president had huge majorities in the House and Senate ? he was free to pursue any policy he pleased. But he did nothing to advance a permanent fix for our broken immigration system. Instead, he failed to act until facing a tough re-election and trying to secure your vote."

    Both sides are crafting aggressive strategies to appeal to a demographic that is by no means monolithic but has supported Democrats in recent elections. Some Republicans fear ? and Democrats hope ? that Obama could capitalize on this moment to help solidify Hispanic voters as predominantly Democratic this fall and for years to come, much as President Lyndon Johnson hardened the black vote for Democrats as he pushed the Civil Rights Act of 1964.

    As is typical, Romney also focused on the economy. The former Massachusetts governor argued that his economic credentials would benefit all people who have struggled under Obama's leadership in recent years ? women, younger voters and Hispanics among them.

    That's a message that resonates with Latinos, according to Vargas. "Overall, what's on the minds of the folks who will be gathering here is the state of the economy ? the need for more jobs," he said. "Latino workers have suffered."

    Regardless of his focus, Romney's appearance will draw attention to his recent rhetoric on the issue.

    Facing a Rhode Island audience in April, for example, Romney drew large cheers when he said: "We want people to come here legally. And we like it when they come here speaking English."

    He did not support the Obama administration's lawsuit challenging Arizona's hardline immigration law. And he said that he would veto the DREAM Act, which would have given legal status to some children of illegal immigrants.

    Obama so far has vastly outspent Romney on Spanish-language television and radio. But Romney has released targeted TV and radio ads in Spanish, including some that feature one of Romney's sons, a fluent Spanish speaker.

    Romney is set to leave Florida later Thursday en route to a three-day retreat with fundraisers in Utah.

    (AP) ? South Korea is forecasting blistering growth in the use of a network technology that gives the fastest speeds for connecting to the Internet from a mobile device.

    South Korea, already known for having the world's speediest fixed-line broadband Internet, was not the first to use the fourth generation mobile technology known as Long Term Evolution. The United States already eclipses South Korea in the number of LTE smartphone users.

    But the proportion of the population using it is higher and rising faster in South Korea than in any other part of the world as mobile operators are making a big push to attract subscribers.

    Some 7 million South Koreans, or about 14 percent of the population, are already using LTE smartphones. That is forecast to jump to about 30 percent of South Koreans within a few months. The proportion in the U.S. is less than 5 percent.

    Based on subscriber targets laid out by South Korea's three mobile operators, the number of South Korean smartphone users accessing the Internet with LTE is expected to reach 15 million by the end of this year.

    South Korea's Electronics and Telecommunications Research Institute said the number of LTE smartphone users will surpass 33 million in 2013.

    That explosive growth means that by next year, most South Korean mobile phone users will be able to download multimedia content and stream videos at a faster speed than other countries.

    Companies offering LTE claim it can stream data as much as five times faster than 3G networks. Those claims are often based on test conditions and the actual performance is likely to be less than that though still noticeably faster than 3G.

    South Korea's smartphone market was kickstarted by the iPhone's launch in 2009 and expanded at a furious rate. The number of smartphone users reached 26 million as of April, allowing over half of the population to surf the web and download mobile applications on the go.

    Around 20 million of them are still using the 3G mobile communication network, which gives a moderate Internet speed and will work fine for most basic functions, such as web surfing.

    Market experts and industry officials believe smartphones that support the 4G mobile communication standard will become mainstream in South Korea as early as the end of this year and well before other countries.

    That is not necessarily because South Koreans have insatiable demand for high-speed mobile Internet.

    In the saturated mobile market, the main operators SK Telecom Co., KT Corp. and LG Uplus Corp. are splurging on marketing expenses to attract new subscribers.

    They are giving generous subsidies to LTE smartphone subscribers while cutting down on subsidies for older devices.

    "South Koreans usually get a new mobile phone in every one and a half or two years. When they get a new handset, they get the latest phone in part because device subsidies are given to the new models only," said Song Young-keun, a senior researcher at the Electronics and Telecommunications Research Institute.

    With Apple Inc. yet to give access to LTE on its iPhone, most LTE handsets are manufactured by South Korean companies: Samsung Electronics Co., LG Electronics Inc. and Pantech Co.

    Although Apple's iPad supports LTE in the United States, the tablet computer is not compatible with South Korean LTE networks.

    The country's small size also allows quick completion of nationwide network coverage. All three operators completed nationwide LTE coverage earlier this year.

    Church abuse victim faces trial for beating priest

    LOS ANGELES (AP) ? Opening statements were scheduled to begin Wednesday in the trial of a man accused of beating an aging Jesuit priest who he says molested him and his younger brother more than 35 years ago.

    William Lynch has said the priest abused him and his brother during a camping trip in Northern California's Santa Cruz Mountains. Now 44, Lynch will get his longtime wish to face the Rev. Jerold Lindner in court for the first time.

    Lynch faces felony charges of assault and elder abuse after prosecutors say he beat Lindner in 2010 in front of startled witnesses at a retirement home for priests.

    In the months since his arrest, Lynch has refused to discuss a plea deal and has grown intent on using his own legal trouble to try Lindner in the court of public opinion in a potentially explosive proceeding likely to include testimony from Lynch, the priest and several more of his alleged victims.

    The trial will take place in Santa Clara County Superior Court, where several other victims are expected to attend. Lynch faces up to four years in prison if convicted on all charges.

    The judge overseeing the case recently ruled that Lynch's lawyer can ask the priest about Lynch's allegations during cross-examination. If Lindner denies the accusations, attorney Pat Harris can call up to three other witnesses who claim they were also molested by Lindner as children, including Lynch's younger brother.

    The Lynches, who were 7 and 4 at the time, were raped in the woods and forced to have oral sex with each other while Lindner watched, according to a civil lawsuit. Lindner has been accused of abuse by nearly a dozen people, including his own sister and nieces and nephews, but was never criminally charged because the allegations were too old.

    Lindner hung up Monday when The Associated Press called him for comment. He has previously denied abusing the Lynch boys and said in a deposition from the late 1990s that he didn't recall the siblings. The brothers settled with the Jesuits of the California Province for $625,000 in 1998.

    Getting Lindner into court ? even as a victim ? has helped Lynch find the peace of mind he's been searching for his whole life, he said.

    "I don't want to go to jail but I've come to realize that this whole thing is really bigger than me and the way that I've chosen to handle this is to make a statement," Lynch told the AP. "I'm prepared to take responsibility for anything I've been involved in. I'm willing to do it. I think it's a small sacrifice to get Father Jerry into court."

    The priest will likely testify at the trial, but Lynch's attempt to shame and expose Lindner is misguided, said Deputy District Attorney Vicki Gemetti.

    Even if the molestation allegations are true, the judge's order only allows the defense to ask general questions about sexual abuse for the purpose of challenging Lindner's credibility as a witness. Other defense witnesses who allege abuse by the priest can't be questioned about specific details that could inflame the jury.

    "What the jury needs to be deciding is did an assault take place? There might be sympathetic reasons for an assault, but yes, it's an assault," Gemetti said. "The victim is not squeaky clean but that doesn't change the fact that you can't take the law into your own hands."

    It's unlikely testimony about Lynch's abuse allegations could tip the case in his favor ? but not impossible, said Jody Armour, a professor at the University of Southern California's Gould School of Law who specializes in criminal law and social justice issues.

    Jurors will have to be reminded not to be swayed by their prejudices or by any sympathy they may feel for Lynch.

    "These are some of the toughest cases in criminal law," Armour said. "Even though that jury will be told, 'Don't think about this, this is not evidence, it just goes to credibility,' how are people going to keep those two things separate in their mind?"

    There have been several other instances of violence, sometimes fatal, against priests accused of abuse since the Roman Catholic clergy abuse scandal unfolded in 2002.

    In Baltimore, a man who claimed he was sodomized and fondled by a priest a decade earlier shot the clergyman three times in 2002 after the priest told him to go away when he demanded an apology. The defendant was acquitted of attempted murder but served 18 months of home detention on a gun conviction.

    The following year, priest John Geoghan was strangled in his cell by a fellow inmate who claimed he was chosen by God to kill pedophiles. Geoghan was serving a 9- to 10-year sentence for groping a boy and was at the center of the Boston clergy abuse scandal. He had been accused of molesting as many as 150 boys.

    Police said they connected Lynch to the May 2010 attack using phone records. A half hour before the beating, a man identifying himself as "Eric" called the rest home and said someone would arrive shortly to inform Lindner of a family member's death.

    When Lindner showed up in the lobby, Lynch asked the 65-year-old priest if he recognized him. After the priest said he did not, Lynch began punching him, according to a police account. On a 911 tape, the assailant can be heard yelling, "Turn yourself in or I'll (expletive) come back and kill you," as a receptionist speaks to a dispatcher.

    Lindner was able to drive himself to the hospital and has since recovered.

    Lindner was removed from ministry and placed at the Los Gatos retirement home in 2001. He was named in two additional lawsuits for abuse between 1973 and 1985, according to the Archdiocese of Los Angeles. Those cases were included in the record $660 million settlement between the church and more than 550 plaintiffs in 2007.

    Even if he is convicted, Lynch hopes that facing the priest in court will help him deal with the demons that he said have held him hostage for years. He has battled depression and alcoholism, attempted suicide and his marriage failed.

    "He still comes into my dreams now. He just took ownership of me in a way that's hard to get rid of and I have to learn how to live with him," Lynch said of the priest.

    "My expectations are realistic, but I'm also coming into this for the first time sort of in control of my life."

    Though the NFL?s in-house appeal process doesn?t amount to a full-blown legal proceeding, the players accused of participating in the Saints? bounty program could escape responsibility on the same basis that plenty of criminal defendants do.

    By relying on a technicality.

    As Article 46 of the Collective Bargaining Agreement goes, there aren?t many technicalities in the appeal process.? Here?s one of them, from Article 46, Section (f)(ii):? ?In appeals under Section 1(a), the parties shall exchange copies of any exhibits upon which they intend to rely no later than three (3) calendar days prior to the hearing.? Failure to timely provide any intended exhibit shall preclude its introduction at the hearing.?

    Key word:? Shall.

    As every law student learns when studying ?civil procedure? (i.e., the rules for litigating cases), the word ?shall? always should (or, I suppose, ?shall?) be regarded as a red flag.? It conveys a mandatory requirement.? No discretion.? No exceptions.? No wiggle room.

    Here, failure to deliver the exhibits on time ?shall? prevent them from being used at the hearing.

    Commissioner Roger Goodell previously scheduled the hearing in the bounty case for 10:00 a.m. ET on Monday, June 18.? The NFL delivered its packet of 16 exhibits to the NFLPA at roughly 1:30 p.m. ET on Friday, June 15.

    Three calendar days prior to the hearing translates, in the normal sense of the term, to at least 72 hours before the hearing.? Actually, it could reasonably be argued that the exhibits were due by 11:59 p.m. on Thursday, June 14, since that would have given the players ?three calendar days? (Friday, Saturday, and Sunday) to digest the evidence and prepare accordingly.

    So by failing to deliver the materials before 10:00 a.m. ET on Friday, June 15, the plain language of the CBA (i.e., ?shall?) prevents the materials from being introduced at the hearing.

    Since the NFL?s entire cases consisted of the 16 exhibits plus comments from outside counsel Mary Jo White regarding their meaning, the failure to deliver the documents by 10:00 a.m. ET on June 15 could get all suspensions thrown out by a court that eventually reviews Commissioner Roger Goodell?s inevitable decision to uphold the penalties he previously crafted.

    Is it a harsh outcome?? It sure is.? But it?s the outcome that the CBA mandates if the exhibits aren?t delivered on time, and it?s an outcome that easily could have been avoided by determining the earliest possible point at which the three-day window may close and making sure that the exhibits were in the hands of the NFLPA before that moment.

    Thousands of lawyers throughout the country routinely apply that concept in a wide variety of proceedings and contexts.? The fact that the NFL has full control over the appeal process doesn?t mean that the NFL has the power to disregard the clear, unambiguous terms of the limited rules that apply.

    Despite a report that the players asked for the hearings to be adjourned in order to have the benefit of the full 72 hours, the official transcript indicates that NFL general counsel Jeff Pash delayed the hearing to ensure compliance with the rule.? But if any delay in the commencement of the hearing time can be used to cure the failure to deliver the exhibits on a timely basis, the clear consequences of the rule can be avoided in any hearing in which the NFL delivered the exhibits late.? Regardless of when the exhibits were tendered, the Commissioner can simply press the pause button until the 72-hour window between the disclosure of the exhibits and the start of the hearing has passed.

    That?s probably not what the rules envision.? And whoever failed to ensure that the exhibits were delivered at least 72 hours before the start of Monday?s hearing probably will be spending some time in the coming weeks and months gnawing on Tums while obsessing over the manner in which this one may play out.
